The challenge of conceptualizing an integral legal treatment that attends to the physical autonomy of women

Abstract

In order to argue, under the dimension of women's physical autonomy, that the conceptualization of the legal treatment of violence against women has been focused on their participation in the private sphere and it lacks intervention in the public sphere, the legislation published on violence against women in Chile between the years 1990 -2020 is analyzed. The analysis is linked to feminist legal theories, understanding that historically the law has conditioned women to a family domestic life. Also, the international and regional instruments of human rights of women are collected, as a legislative guide framework of violence against women for the States. Finally, the demands of the women’s and feminist movement are made visible in their struggle for the right to live a life free of violence.
