The use of videoconference in trial hearing: Untrust in the technology or in the declaratory evidence?

Abstract

This paper argues that the background regarding the discussion on the use of remote systems for conducting hearings in which declarative evidence is developed goes beyond an alleged infringement of due process resulting mainly from a dubious transgression of immediacy, and what lies behind is the demonstration of distrust in these means of evidence considering the little credibility that is held in people. In other words, the resentments presented by the execution of these hearings are not due to the technological means used but to the evidence itself, which happens both in person and virtually.
