Abstract

The article deals with the discussion around the theory of justification of the punitive practice that may be developed on the basis of John Rawls' work of political philosophy. It explores a proposal that places an authentic standard of criminal justice in Rawls's work, along with the classic standard of political distributive justice. Secondly, it discusses the foundations of moral philosophy of a certain critique to the mentioned proposal. Finally ir briefly develops the relationship between political philosophy (theory of justice) and the justification of the punitive practice (theory of punishment) as part of the contemporary debate about these matters.
