Abstract

The expansion and intensification of criminal law, commonly associated with its modern characterization, are reflected preferably in reactions to risks and insecurity that produces the common or everyday crime area that has been hit by this method further configuration of penal institutions, instead of going to mass, technological and global risks that originate. Shapes, in short, a law based on the logic of exception from the offender-based criminal law from the feeling of insecurity applied to everyday life, generating main effect a reduction in the potential for regulatory interaction posed by criminal law. Unfortunately and assuming attitudes in general has adopted the doctrine against these postmodern characters, the most advisable posture seems to highlight the main idea of rethinking the basic contents that shape.
