Stop and identity by Carabineros: An empirical approach and assessment in Chile

Abstract

During the last years an important public debate has arisen regarding the regulation and practical use of the power to stop and ask for identification in Chile. Notwithstanding this debate lacks of evidence and other empirical data to sustain the several arguments use to justify its continuous reforms proposals. In this context, this article intends to contribute to such public debate and to a better understanding on how this mechanism it is used by providing new data gathered from different sources that allows to provide a better image of its current practice. Moreover, it goes further by providing an analysis of the most relevant parameters that has been under debate: its efficacy and its potential discriminatory use. Altogether with public available official descriptive statistics, the article is supported in the use of a database containing the total of stop and identity controls applied by Carabineros during an entire year between April 2017 and March 2018, which was received by the authors in January 2019, after a dilated litigation on the right to access to public information proceedings.
