Approach to article 68 ter of the Chilean Penal Code

Abstract

The paper examines article 68 ter of the Penal Code from the central perspective of its effective capacity to generate a greater penalty for convicted repeat offenders, an objective assigned -although not in an unquestionable way- to its recent incorporation as a precept for determination of punishment of the Chilean system. To this end, the regulation provided in paragraph 1° for criminal recidivism is specially analyzed, whether it is presented solely through one of the aggravating circumstances that shape it or together with the mitigating circumstances of incomplete defense or substantial collaboration, also covering a general analysis of its impact on the special system for determining the sentence for crimes against property; and the possibilities that arise for scenarios of the concurrence of modifying circumstances that are not expressly regulated in said provision are also explored.
