Abstract

Indirect perpetration is a complex way of establishing criminal responsability. Therefore it is advisable to analyze its requirements in light of examples that have been raised in doctrine and jurisprudence. For this reason, this article aims to explain the concept of indirect perpetration through specific cases, both in terms of its assumptions and discussions about its basis. On this occasion, the article will focus on situations in which the person in front acts with a defect of imputation, that is, for some reason they cannot be charged with the commission of a criminal act.
