The denaturalizing impropriety of the action for protection in Ecuador

Abstract

Ecuadorian constitutional jurisprudence has identified the "acción de protección" as the principal judicial guarantee for safeguarding the right to an effective remedy, as recognized in Article 25 of the American Convention on Human Rights. Since 2019, however, the Constitutional Court of Ecuador has shown a growing concern with regulating this mechanism, seeking to prevent its misuse and to avoid the risk of its distortion. This article offers a systemic analysis of the Court’s recent case law, examining the main scenarios in which the scope and limits of the acción de protección have been defined. It further contrasts these domestic developments with Inter-American standards on judicial protection and, from a critical perspective, advances possible normative and institutional reforms to address the tensions identified.
